What are the Annual Dues used for?

If I don't pay my dues what are the legal remedies?

See Covenants, Article IV -Sec. 8. Late fees are charged. If payment is still not received after three notices are sent, then a lien is filed against the property which includes assessment, interest, attorney fees, notary fees, recording fees and accrued rebilling fees.

Neighborhood Information

Do I have to belong to the Homeowners Association?

YES - It is mandatory - a legal entity agreed to when you closed on the purchase of your home.

3.

What types of wildlife are prevalent in Comstock Village?

Black bears, deer, rabbit, fox, raccoons, coyotes, bobcats, mountain lions, snakes, eagles, falcons, owls and a large variety of migratory and local residing birds.

How can I get involved as a Comstock resident?

Contact one of the Board Members or submit your name prior to the Annual Meeting in October. The Board is always happy to have a volunteer run for an elected position on the Board. We also have a Traffic Committee and a Common Area Committee that would welcome your participation.

Is there a Neighborhood Watch program?

Yes, there is. Many areas have active Neighborhood Watch programs. It is a program that a small group of neighbors must organize and contact the police to be registered. CVHA as a whole cannot form the group.

9.

What are the rules for parking motor homes, trailers or large commercial vehicles in Comstock?

A motor home or trailer may only be parked for loading or unloading for up to 72 hours each way. No motor home or trailer may be stored on the property unless it can be parked in a garage or in a location on the property where it cannot be seen from the street. No commercial size vehicle may be parked on the property on a regular basis. See Article VI, Section 7, paragraph 12 of the Covenants.

Does the Homeowner's Association own the Common Areas?

Yes – 44 acres of them.

6.

What are the neighborhood schools for Comstock Village residents?

Our community is located in Academy School District 20, a high performing district dedicated to national and international standards of excellence. The neighborhood schools are Foothills Elementary School or Rockrimmon Elementary School (depending upon your address), Eagleview Middle School and Air Academy High School.

8.

Who is responsible for fixing sidewalks in Comstock Village?

Once installed, property owners are responsible for sidewalks adjacent to their property to include those that are behind your fences. Owners are responsible for snow clearance, which must be removed within 48 hours after a storm. Owners are also responsible for insuring that sidewalks remain traffic free from overgrown vegetation.

Home Improvement Regulations

What changes to my property must I get Architectural approval to do?

How do I know what paint colors are acceptable and earth tone?

Please contact our Administrator who has paint samples that will give you an abundance of choices from which to choose.

Can I replace my roof with wood shake shingles because that's what the covenants require?

No. The City of Colorado Springs passed an ordinance in 2002 requiring ALL roofing material must be CLASS A, banning wood shake shingles. An ordinance takes precedence over covenants. The Board of Directors has adopted/approved standards that address the type, quality and color of materials that may be used, and homeowners are required to obtain approval from the Board before they replace their roof.

Covenants, Reports, and Assessments

Should I have received a copy of the covenants when I purchased my home?

Yes. Your Title Company should have provided you with a copy. Please click here to find the PDF file of the covenants for download if you need one.

3.

Can the Board of Directors order exterior maintenance be done by an outside contractor if the owner has been negligent in maintaining the property?

Yes, after giving the owner appropriate notice. The owner will then be charged the cost of the maintenance done against future assessments or an assessment lien will be filed against the property.

5.

I notice there are replacement materials being used that do not meet the covenant description. How are these approvals determined?

The Board of Directors for Comstock Village realizes that newer products should be considered and they evaluate those requests when submitted.

How do I report violations of the covenants in my neighborhood?

A letter or email should be directed to the Board or to the Comstock Village Administrator. Please include your name and a method of being contacted. We need to be able to discuss your concern directly with you.

4.

Why don't you amend the covenants to make them consistent with current and future building materials?

The Covenants can be changed with 60% of the homeowners’ approval. Suggestions for changing the Covenants are accepted by the Board and are periodically presented to the membership for a vote.

6.

Is the Assessment Annual or Monthly?

It is an Annual Assessment. Invoices are sent the first business day of January and are payable upon receipt. Late notices with associated fees are sent after February 15th to all homeowners who have failed to pay the assessment by the required February 15th postmark date. The Annual Assessment for 2018 is $43.00.
